Vietnam to Fine Retail Crypto Traders Using Offshore Exchanges

Vietnam crypto fines will begin on September 1 under Decree 284/2026, with retail traders facing penalties for using unlicensed digital asset platforms.

Individuals who trade through providers not licensed by the Ministry of Finance could be fined up to VND 50 million, or about $1,900. Meanwhile, penalties can reach VND 100 million for trading assets that are approved only for foreign investors. The change moves enforcement beyond exchanges and puts direct liability on end users.

Vietnam has a large retail crypto market, and many users have accessed digital assets through offshore exchanges such as Binance and Bybit. However, those platforms have often operated in a legal grey area. As a result, the new decree gives traders a clear financial reason to use licensed local venues.

Vietnam Crypto Fines Reshape Market Access

Vietnam plans to approve no more than five crypto exchanges in the first phase of its new framework. Eligible operators must hold charter capital of at least VND 10 trillion, or roughly $382 million. Therefore, the market structure will remain tightly controlled.

Foreign investors will be limited to 49% ownership in local crypto businesses. In addition, all trading and settlement must take place in Vietnamese dong. The rules point to a closed licensing model rather than a broad open market.

New Rules Tighten Compliance Demands

Vietnam created the legal base for the licensing regime through the Law on Digital Technology Industry, which took effect in January 2026. That law formally classified virtual and crypto assets. Consequently, licensed domestic firms now become the main route into the market under the pilot framework.

The decree also increases compliance pressure on firms serving Vietnamese clients. Companies that do not verify customer identities can face fines of up to VND 70 million. Moreover, the rules make geofencing and KYC more important because users themselves can now be punished for trading on the wrong platform.
