CFTC Warns Exchanges on Prediction-Market Reward Filings

CFTC prediction market rewards came under closer review after the agency warned exchanges that weak filings could slow approval. The advisory, issued on Wednesday, covers market-maker, liquidity, and trading reward programs filed through the self-certification process. The Division of Market Oversight said the guidance does not add new duties. However, it sets out what staff expects under Regulations 40.5 and 40.6.

Designated contract markets must file incentive-program rules before launch. Under Regulation 40.6, the review usually lasts 10 business days unless the CFTC steps in. If an exchange makes a material change, it must submit the program again. As a result, the 10-business-day review starts over.

CFTC Prediction Market Rewards Filing Standards

The agency said each filing must describe the program’s purpose and length. It also must list covered contracts, participant duties, performance targets, eligibility rules, and pay terms. In addition, exchanges must explain how the program meets core principles on market integrity, access, competition, and conflicts.

Staff said supplements alone are not enough for major changes. A new certification is required if an exchange changes payouts, duties, asset classes, eligibility, enrollment caps, or duration. Each program must go through the CFTC portal on its own, with all related documents in one filing. Meanwhile, exchanges must post non-confidential materials on their own websites at the same time.

The CFTC said substantive edits reset the process. An exchange must withdraw the pending filing and submit it again. The agency may also ask for more details, seek changes, or stay a program if the material is incomplete, complex, or may conflict with federal law. Staff also urged exchanges to review earlier programs and file any needed amendments by September 14.

Risks From Trading Incentives

The advisory focused on rewards that may change trading behavior. Steep volume tiers or bonus thresholds may push traders to chase targets. Therefore, the agency said such structures can raise the risk of wash trades, pre-arranged deals, and other abusive conduct.

The CFTC also flagged programs that cover losses or offer unlimited rebates. It said exchanges should link each reward to the behavior it may drive and build surveillance around that risk. Suggested controls include real-time monitoring, wash-trading alerts, and closer checks of activity near reward thresholds.

Additionally, the agency warned against secret discount codes, informal VIP access, and faster market data or application programming interface access for select users. It said benefits within the same participant group should be objective, clear, and applied evenly. Sweepstakes, casino-style rewards, and spin-the-wheel offers are also likely to clash with impartial-access rules when luck decides the benefit.
